1. Agreement to Terms

By downloading, installing, or using Aircraft ID ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Aircraft ID is a mobile application that uses artificial intelligence to:

• Analyze photographs of aircraft
• Identify aircraft types and models
• Provide detailed specifications and historical context
• Offer identification tips and expert analysis

Important Disclaimer: The App provides estimates and suggestions based on AI analysis. Results are for informational purposes only and should not be considered professional appraisals or definitive authentication.

3. License to Use

Grant of License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.

Restrictions

You may NOT:

• Modify, reverse engineer, or decompile the App
• Use the App for any illegal or unauthorized purpose
• Copy, distribute, or sell any part of the App
• Remove any copyright or proprietary notices
• Use the App to harm, abuse, or harass others
• Attempt to gain unauthorized access to our systems
• Use automated systems to access the App without permission

4. Subscriptions and Payments

Premium Subscription

Available as:

• Monthly Subscription: $4.99/month
• Yearly Subscription: $19.99/year

Payment Terms

• All payments are processed through Apple's App Store
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your Apple account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage or cancel your subscription through your Apple account settings
• No refunds for partial subscription periods
• Cancellation takes effect at the end of the current billing period

Price Changes

We reserve the right to change subscription prices with notice. Price changes will not affect active subscriptions until renewal.

5. User Content

Photos You Provide

• You retain all rights to photos you submit for analysis
• By submitting photos, you grant us a limited license to process them solely for providing analysis services
• We do not claim ownership of your photos
• Photos are deleted after analysis is complete

Your Responsibilities

You represent and warrant that:

• You own or have rights to all photos you submit
• Your photos do not violate any third-party rights
• Your photos do not contain illegal, harmful, or offensive content

6. Disclaimers and Limitations

No Professional Advice

The App provides:

• Estimates, not appraisals: Valuations are AI-generated estimates, not professional appraisals
• Suggestions, not authentication: Identification is probabilistic and may be incorrect
• General information, not expert advice: Information is for general guidance only

IMPORTANT: For professional authentication or valuation, consult a qualified aviation expert.

Accuracy Disclaimer

We do not guarantee:

• Accuracy or completeness of analysis results
• Identification will be correct
• Valuations reflect actual market value
• Historical information is error-free

Safety Disclaimer

AIRCRAFT IDENTIFICATION IS FOR INFORMATIONAL PURPOSES ONLY

• The App provides general information only
• We are not responsible for any issues related to aircraft identification or operation
• Consult appropriate aviation authorities for official identification
• Follow all local laws and regulations regarding aviation and photography

Use at Your Own Risk

You acknowledge that:

• Analysis results may be inaccurate
• You should not rely solely on the App for important decisions
• Market values can vary significantly from estimates
• Misidentification is possible

7. Intellectual Property

Our Rights

All content, features, and functionality in the App are owned by us and are protected by copyright, trademark, patent, and other intellectual property laws.

Feedback

If you provide feedback or suggestions about the App:

• We may use your feedback without obligation to you
• You grant us an unlimited, irrevocable license to use feedback
• No compensation will be provided for feedback

8. Third-Party Services

OpenAI Integration

The App uses OpenAI's API for image analysis:

• OpenAI has its own terms and privacy policies
• We are not responsible for OpenAI's services or policies
• Service availability depends on OpenAI's service

Apple App Store

• Subscriptions are governed by Apple's Terms and Conditions
• Refund requests must be made through Apple
• Apple is not responsible for the App's content or functionality

9. Termination

Your Right to Terminate

You may stop using the App at any time by uninstalling the App and canceling your subscription through Apple.

Our Right to Terminate

We may suspend or terminate your access if you violate these Terms, engage in fraudulent activity, or abuse the service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We are NOT liable for indirect, incidental, or consequential damages, loss of profits, data, or business opportunities, or damages from use or inability to use the App.

Maximum Liability: Our total liability is limited to the amount you paid for the App in the 12 months before the claim, or $100, whichever is less.

11. Warranty Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We do not warrant that the App will meet your requirements, that results will be accurate, or that the App is secure or virus-free.

12. Changes to Terms

We may modify these Terms at any time. Notice will be provided through the App, and continued use after changes constitutes acceptance.

13. Dispute Resolution

Any disputes will be resolved through binding arbitration rather than court, except for small claims court disputes and intellectual property disputes.
